Category XIV (toxicological agents) and XVIII(directed energy weapons) Final Rule Published

On July 28, 2016 the Commerce and State Departments issued notices amending Category XIV (toxicological agents) and XVIII (directed energy weapons).  This transition will go into effect on December 21, 2016.  Category XIV, using guidance from the Department of Health and Human Services and Department of Agriculture, establishes a list of Tier 1 pathogens and toxins with clear guidance between DDTC and BIS jurisdiction items. Additional items remaining under the USML include enumerated biological/chemical agents exclusively funded by the Department of Defense. A series of new EECNs will be created for transitioning items, 1X607. The items being transitioned from this category are primarily equipment used for protection, dissemination, detection, etc.; test equipment; and related articles.

Category XVIII revises directed energy weapons. All items currently covered under paragraphs (c) and (d) will be transitioned to the CCL. This includes specially designed tooling and equipment for the production of items controlled by this category (paragraph c) and test/evaluation equipment (paragraph d). These transitioned items will be controlled by a series of new ECCNs- 6B619, 6D619, and 6E619.
