ITAR Recent Changes – Return of Licenses and USML Clarifications

On Thursday, October 4, the U.S. Department of State eliminated the requirement to return licenses for technical data. Prior to the change, exporters were required to return licenses after the initial export of technical data, and all licenses that were exported against but not electronically decremented. The language regarding license return was removed from ITAR Section 123.22(b)(3)(i) and (c)(2).

In the same Federal Register notice, the Department of State also removed several items from the United States Munitions List. A note was added to Category IV to clarify that it does not control thrusters for spacecraft. Category V was noted to clarify it does not control items incorporated into items subject to the EAR and classified under ECCN 1C608. Control texts were revised in Categories VII, XI, and XV pertaining to drone technology, radar, and defense services.
