New Russia Sanctions to be Imposed in August 2018 by the U.S. Department of State

Chemical and Biological Weapons (CBW) Sanctions which will be imposed on Russia by the U.S. State Department on or about August 22, 2018 include the imposition of a “presumption of denial” for export licenses for US origin national security-sensitive goods and technology controlled by the US Department of Commerce’s Export Administration Regulations to any Russian state-owned or state-funded enterprise. These items would require an export license for export from the U.S., but under these sanctions any submitted licenses will not be approved.

There are a number of carve-outs for the sanctions including a waiver for the provision of foreign assistance to Russia and the Russian people, space flight activities and safety of commercial passenger aviation.

The Federal Register notice imposing the above sanctions will be issued around August 22nd. A second set of sanctions may be imposed in 90 days if certain criteria are not met by Russia.
