Export Policies and Procedures

Policies and Procedures

As the U.S. government is becoming more aggressive in export compliance investigations, it is recommended that companies have in place export policies and procedures to ensure employee’s compliance with U.S. export laws and regulations. In light of Export Control Reform, companies with older Policies and Procedures enacted may find these out of date and no longer valid.  A complete export compliance plan consists of both an Export Licensing and Compliance/Control Policies and Procedures and a Technology Control Plan.   These two documents not only provide direction and controls to ensure a company’s compliance with U.S. export laws and regulations but are also necessary for defense should errors in U.S. export/transfer of technical data or product occur.

The Policies and Procedures primarily controls sales/shipment of product but also contains controls over technical data, details proper export documentation & record keeping, and describes export training and audit procedures. The TCP is used mainly to restrict Foreign National Visitors and Employees from controlled product and information.  Both are important to ensure a company’s compliance with changing US. Export laws and regulations.
