Proposed Changes to Military Aircraft and Engine Regulations


On February 9, the State and Commerce Departments published proposed revisions to the Military Aircraft and Engine regulations.  As stated in the revision by Commerce, these amendments allow for DDTC and BIS to account for “technological developments and practical application issues”. One clarification from BIS is that a note will be added to §740.2 including forgings, casting and other unfinished products that are clearly identifiable as the commodity if the commodity is a 600 series item. An additional Commerce proposed change recommends the expansion of many of the 9A610.y, allowing more items to fit under these classifications.  The State Department’s Amendment to ITAR Categories VIII and XIX clarifies language throughout the two categories.  An additional proposed change would allow ITAR controlled engines incorporated into an EAR 600 series aircraft to be able to be licensed by BIS. The proposed changes are currently open for public comment. Once the final rule has been issued Wilmarth & Associates will issue a blog post explaining the specific revisions to the regulations.
