Additional Restrictions for Venezuela

On November 7, the Commerce Department’s Bureau of Industry and Security released a new set of restrictions (79 FR 66288) for exports to Venezuela. In light of the government’s violent oppression of anti-government protests and their attempts to “undermine democratic processes and institutions and thereby constitute an unusual and extraordinary threat to the national security and foreign policy of the United States”, the US government included Venezuela with Russia and China with expanded license requirements for “military end use” and military end user items. BIS amended EAR §744.21 to include these requirements for Venezuela.

Contracts signed before November 7, 2014 will not be effected by these change. When filing for license applications, applicants must state all known information regarding the military end user or end use in Venezuela.  If BIS determines that granting the license will be making a material contribution to the Venezuelan military or would advance the Venezuelan military contrary to the national security interests of the USA, the license will be denied.
